أحكام الوقف في الفقه الإسلامي ومقاصده الشرعية: تطبيقا على الشمال النيجيري

Abstract

This research discusses an appraisal on the approach of Islamic waqf law and its practices in Northern Nigeria; is aimed principally to submission to the Will of Allah through the practice of spending and giving out charity. The study was able to link the general objectives of the Shariah (maqasidul amma li-Shariah) with the objectives of Waqf. It was clear through this research that the law of waqf was in existence in this part of Nigeria though it was limited to the mosque and cemetery waqf. The research also revealed that the people of this part of Nigeria are living under total poverty and deprivation. The study is intended to sticking out the major role of waqf in eliminating unwanted habits in the society like misery greed and selfishness through the practice of waqf. The study find out that waqf practice made some achievements in solving social and economic problems in the practicing states as compared to the non-practicing states. The major types of waqf practiced in the North was charitable waqf (waqf al-khairi)، which shows an indication that the country generally is living in poverty. The study declared that there is plenty of wealth in the North and if utilized under waqf venture can bring positive change to many people. Finally the research concluded with some recommendation that waqf money to be invested and the gain be committed to the progress of the poor. It is also important that the various boards in the state be committed to the progress of this wealth and that there shall be a law guiding the administration of waqf. Waqf wealth shall be registered in Shari ‘ah courts which shall issue certificate therein and in turn a copy is filled by the respective boards.
