Abstract: Abstract This research is a study on the (constitutional vacuum and its application in Somalia- comparative study), the researcher provided the theoretical framework for the concept of a constitutional vacuum, and studied the constitutional vacuum according to the legitimacy, then he started to apply that concept on the country of study (Somalia), then he talked about historical background of Somalia, and the state stages of Somalia, and the factors caused the collapse of it, then he studied indicators which indicate a constitutional vacuum in Somalia, and the efforts from the local community, and the international community to solve this problem. The important objective of the research was to study Constitutional vacuum in Somalia, and to clarify aspects of it. To achieve these goals researcher used legal references, and biographies, and books on Somalia, and articles written about it, and any means necessary to complete this research. During this study the researcher faced several difficulties, such as lack of legal references on the constitutional problem in Somalia, and the lack of references dealt with constitutional vacuum. Finally, the researcher found some results and the voluble information on the subject of the study and the most important results is :Somalia has entered into a constitutional vacuum stage, since the collapse of the Somalia state 1991 until now.
