Abstract: This paper was titled the concept of crimes against humanity in the Sudanese Criminal Act of 1991, international conventions and covenants", This is the subject of modern subjects in the provisions of the Sudanese Criminal Act (1991) where is included in the amendment (2009). The problem lies in this paper, "the legitimacy of the legal and constitutional acts of these new provisions retroactively to crimes committed before the birth of the texts themselves. this paper followed the analytical descriptive approach as a comparative legal study need to view and analyze legal texts and match them with what it is the case in the international conventions and instruments relevant to the subject of the study. The study was divided into five demands to deal with some of this subject in detail and comprehensive, which reached a number of conclusions, most notably: that these crimes no statute of limitations. And that the penalties prescribed for such offenses in international conventions and covenants are weak compared to the magnitude and seriousness of these crimes. In contrast, the study recommended a number of recommendations, including the need to prosecute those responsible for these crimes committed in Darfur at the local level, and state and central, on the one hand, In terms of the study it recommends that the international community adopts a representative of the United Nations project to include the death penalty among the penalties
