Abstract

Praise is to God, who with his blessing the good deeds complete and by his reconciliation the darkness comes clear. Grant us by his kindness, honeydew and generosity to complete this study, after a long journey, grace for him first and last. All beginnings have the end yet it prolongs, that’s exactly happen for this work that took more than two years but at the time the light come out. The objective of this study is "The inheritance system in Islamic Sharia and the impact of violating its principles. (A practical study in Zanzibar),. The researcher divides this study into introductory chapter and other two chapters, conclusion, table of contents, starting with research basics. The researcher divides this study into introductory chapter and other two chapters, conclusion, table of contents, starting with research basics. The research problem is existences of the wrong implementation in inheritance system in Zanzibar whereby the reason of that exercise is not clear. Whereby the several questions arise from the on hand problem including: Which problems facing Zanzibar in inheritance system? Are there any effects caused by the wrong exercise of inheritance system in Zanzibar? What are the fundamental orders putted in place by Islamic law concerning inheritance? How does institutions responsible for inheritance and Islamic court exercise fundamental orders putted in place by Islam? Are there any practical relevant means that can solve the inheritance problem facing Zanzibar? The study tests the following hypothesis: There is a problem facing Muslim society in Zanzibar, concerning lack of excising the Islamic system and principle of inheritance in Zanzibar. The institutions responsible for inheritance in Islamic court facing social challenges relating to inheritance issue. There are some practical relevant ways and means that can solve the inheritance challenge facing Zanzibar. The study concludes the general orders in Islamic and non Islamic law to be sensitized and legal controlled. The research applies abstractive and historical methods in short history of Zanzibar, comparative qualitative method following four jurisprudence doctrine
