Abstract

This study dealt with the TRIPS Agreement and its impact on Sudan. The problem of the study is the ambiguity, inaccuracy and inconsistencies in some provisions of the agreement and the provisions of the Sudanese intellectual property law. The study aims at contributing to the protection and enforcement of intellectual property rights to encourage the spirit of innovation, to know the advantages of the study and to show it, to face the negative aspects of the study and to address it. The study included the definition, development and protection of intellectual property, the definition of the Convention, its characteristics, requirements, objectives, access and impact on Sudanese intellectual property law and the expected results of TRIPS enforcement. The impact of the implementation of the TRIPS Agreement varies according to the level of economic and technical development of each country. Sudan is poorer and the innovation is at its lowest levels, and most of the year it will face increased expenses without enjoying balanced benefits. The most important recommendation of the study is that national laws and legislations should be amended to comply with all the provisions of the TRIPS Agreement. Sudan should also undertake the infrastructure and development of administrations that will deal with and implement the provisions of the TRIPS Agreement.
