المسئولية الجنائية للشاهد في القانون السوداني : دراسة مقارنة

Abstract

This study is entitled: The criminal responsibility of the witness on the facts witnessed by him, and the importance of this study seems to be that the certificate in the criminal field is one of the most important elements and elements of criminal justice. The purpose of this study is to clarify the criminal liability of the witness. The study also attempted to address the issue of the adequacy of the criminal and penal texts in the case of the criminal witness, as well as the facts that constitute a crime against justice and the controls that govern it. For this reason, this study followed the descriptive analytical approach as a comparative legal study. Based on the above, the study reached several conclusions, the most important of which is: The Sudanese Criminal Code explicitly states the crimes that are responsible for the criminal witness's responsibility, on the one hand. On the other hand, the study concluded that the responsibility of the criminal witness is an exceptional responsibility because the law discriminates against the witness from prosecution. The study also recommended a number of recommendations, the most important of which are: Civil society organizations play a positive role in spreading and consolidating the legal culture of the members of society so that they are aware of their rights and duties towards the provisions of the principle of rule of law. In addition, the courts shall tighten the penalty, especially in the case of the execution of the judgment against the person who is known against him under perjury.
