Abstract

This study addressed the woman political rights through a comparative approach between Islamic perspective and substantive law in three chapters, in addition to the research basis. In chapter one, the study handled the concept of the woman political rights, their origin and development as well as the rights given to the woman by the divine laws in terms of her humanity regardless of her religion and beliefs. The study also showed comparative aspects between Islamic Sharia laws and the previous divine laws and the rights enjoyed by the woman in the modern era after the bitter long struggle. In chapter two, the study showed the legitimacy of the woman political rights from the Islamic perspective and the substantive law as well as the regulations which protect those rights from both systems. It also showed the similarities and differences between those systems and the crucial things which characterized Islamic Sharia law from the substantive law. Chapter three tackled the nature of woman political rights in the constitution of the Republic of Chad and the opportunities of promoting the woman participation in the future. The State setup many strategies to guarantee her participation widely more than before. The study also reached that the Chadian legislator guaranteed the woman full political rights, equal to a man without any discrimination. Virtually, the woman had exercised those rights but some social, economic and political rights still ineffectual. The study concluded with the results and recommendations.
