حصانة المنظمات الدولية وآثارها القانونية على الدولة: دراسة مقارنة

Abstract

The definition of immunities of international organizations in the law means grant a protection to international organizations by means of facilitating the job of these international organizations. Countries found due to its alternative relations that immunities is opposite to the principle of equity, also we found that immunities defined by humans is the personal and parliament immunity and also the immunity of international organizations. But it does not mean that international organizations become, according to this immunity above the law without liabilities or control. Immunity is not unlimited, because it decided for a specific goal, clear and cannot be bypassed, Otherwise, international organizations came under the full responsibility. To set a precise definition for the international organization is not easy , especially that the international organization is a relatively recent phenomenon in the international life. Views and opinions are differ regarding the definition of International Organization, the most famous of these definitions that tend to the researcher, the definition that describes the international organization as (Each a group of countries agreed to establishment of cooperation between them in the field or several areas). Because of the importance of these organization the international law grant a total of immunities to do their works and tasks completely. The researcher dealt with this study to stand on the effect of these immunities on the countries and its security due to figh and law frame, also what is the basic of these immunities, and to what extent these organization commit with it, and to what extent it compatible with Islamic figh, and what is the legitimacy of using these immunities by international organizations to improve their goals. The researcher will answer all these questions through addressing the study.
