Abstract

This research deals with the subject of pension rights to the heirs of the armed forces members, compared to pension laws related, and the provisions of Islamic jurisprudence related to inheritance. represented research problem in that when the transfer of those rights to the heirs of the deceased, under the pension law, the adaptation is not aligned with the provisions of inheritance in Islamic jurisprudence. The researcher noted dissatisfaction with the heirs of the deceased, and their discontent, and complained that the law set it in order for them, or against them, when engaged with the procedures pension rights of their late. One of the reasons for choosing this title, the theme of the cataclysms of the times, it was not known before, and is beset with some questions, so it needs to look and reflect and study and discuss. The research compared to the Armed Forces Pension Act and other Pensions Acts, and Islamic jurisprudence, and the statement of the importance of granting pension rights for the gene as an inalienable right, and remains, the content of the heirs, like other inherited funds. Search among its objectives and seeks to create a legal formats through the recommendations of the study to keep pace with the Islamic legislation, to maturity and the distribution of the rights of and pension of the deceased more equitably. I have used in my research the deductive, comparison and historical methods. My tools and means were observation, questionnaire, personal interviews, and legitimacy Fatawa I Come with the results, recommendations, and suggestions of this research.
