Abstract

The study dealt with criminal responsibility in the crime of genocide, a comparative study. The problem was raised, among other questions, what is the criminal responsibility of the perpetrators of the crime of genocide and what is the role of the international judiciary and international legislation in determining this responsibility? . The study aimed to shed light on the crime of genocide in terms of the impact and criminal responsibility between international laws and Sudanese law and Islamic law. The study aimed to give a clear picture of the criminal responsibility in international laws and legislation and Islamic law. The study concluded with a number of results, the most important of which is the synchronization of the physical and moral elements together to be One unit in the appearance of military behavior, which is applicableto the Genocide Law, recommended several recommendations that include the prohibition of acts that are contrary to the provisions of international humanitarian law, including crimes against humanity and war crimes The crimes of genocide in the national legislation of any Member State of the United Nations and the provision of penal personnel commensurate with those crimes in their legislation.
