| Abstract: | The study dealt with the subject of “the provisions of the testimony in Islamic jurisprudence and the Nigerian Law of Evidence 2011 a comparative study”,in four chapters and in each chapter three research, chapter one shows the basics of research, which included three questions, then the second chapter, which we adopt the concept of certificate in Islamic jurisprudence and Nigerian Law of Evidence 2011, The third chapter is the authoritative of testimony in the Islamic jurisprudence and Nigerian law of evidence 2011, and finally Chapter IV we meet the conditions of the testimony in Islamic jurisprudence and the Nigerian Evidence Act 2011, and ADALAof witness and credibility. The results of this study show that the Nigerian Law of Evidence 2011, has a narrow concept about testimony not like the Islamic jurisprudence which expands on testimony, because the Islamic jurisprudence deals with the conditions of the witness and the terms of the testimony, general and special, All these differences are because, Islamic jurisprudence is driven from the Quran and the Sunna, and the consensus and measurement and the sayings of scholars, and the Nigerian Evidence Act 2011 built on a secular theory. |
