The results of this study show that the Nigerian Law of Evidence 2011, has a narrow concept about testimony not like the Islamic jurisprudence which expands on testimony, because the Islamic jurisprudence deals with the conditions of the witness and the terms of the testimony, general and special, All these differences are because, Islamic jurisprudence is driven from the Quran and the Sunna, and the consensus and measurement and the sayings of scholars, and the Nigerian Evidence Act 2011 built on a secular theory.
