Abstract

In this research, the study discussed the composition of the presidency of the state in the Islamic thought and contemporary constitutional though- it is a comparative study applied to the Sudan in the light of its constitutions from independence 1953 until the transitional of Sudan in 2005, in terms of definition and importance of the presidency of the state as well as elements and types of state, Islamic and constitutional though in terms of composition and terms of elect of the president or the caliphate and political regimes in Sudan in term of characteristic, elements and conditions of the selection of the president. And finally the legal adaptatation of the terms of the presidency of the president. And finally the legal adaptation of the terms of the presidency of the State in the Sudan and this is in three sections as follows section one : This section represents the theoretical framework of the research, which is based on two chapters: In the first research basics, and the previous two studies. Section Two: the study dealt with the formation of the presidency of state in three consecutive chapters as follows: Chapter 1: It analyzed and studied the definition and legitimacy of the presidency of the state as well as the definition and importance of the state in Islamic thought and contemporary constitutional thought, Chapter:11 The study dealt with the pillars of the state- the people- the region political power in Islamic thought and contemporary constitutional thought. Chapter 111: I listed the types of state in Islamic thought and contemporary constitutional though. Section three: The study focused on the presidency of the state in Islamic thought and contemporary constitutional though in three consecutive chapters as follows: Chapter I dealt with the study of the composition of the presidency of the State in terms of composition and conditions of choice of the president and successor in the Islamic thought and constitutional contemporary. Chapter Two: The study of the presidency of the State in the Sudan under the presidential and parliamentary systems in the light of the constitutions of Sudan since independence and the Constitution of 1956 to 1998 in terms of how to choose and conditions: Chapter 111: The study dealt with the presidency of the State in the Sudan in the period 2005-2011 in terms of the reasons- characteristics of the effects and the legal and legal adjustment to the conditions of the presidency of the state and then was the conclusion that included the findings and recommendations.
