Abstract: There is no doubt that the phenomenon of illegal immigration is a frightening obsession that threatens the safety of the homeland in all countries of the exported and receiving countries. Therefore, the problem of illegal immigration is one of the most dangerous negative phenomena observed in the modern era, especially in the recent period through transit countries, and with the spread of wars, political conflicts, and crimes Terrorist organizations. The importance of this study comes in that illegal immigration is the negative face of the right to movement, in order to determine the legal and practical obstacles and problems related to illegal immigration, since the crime of illegal immigration is a recent crime that negatively affects the receiving countries, and the lack of modern legislation criminalizing it in the way that Compatible with reducing the phenomenon that has become a scourge of the modern era. Through what was researched in this study, the researcher reached some results, most notably: • Illegal immigration is not just an ordinary phenomenon; it is, according to legal adjustment, a crime punishable by both domestic and international law. • The phenomenon of illegal immigration means that a person enters another country illegally or even legally, and then deliberately violating the law in the host country such as the end of the period of stay and not leaving, with the intention of staying in that country. • There are many negative effects that result from illegal immigration, and these effects are not limited to the countries that migrate to, but extend to the countries that migrate from, and these effects are economic, social and security implications. In the process of these results, the research study reached several recommendations, including: • Illegal immigration must be combated within the framework of strict respect for human rights and dignity alongside international and national cooperation, and mutual responsibility between countries of origin, transit and destination. • Given that the phenomenon of illegal immigration has become a dangerous global phenomenon, however, international efforts to combat this crime are few at the global level, as there is not enough to have a protocol on combating this crime, but it is necessary to conclude other country agreements in order to cooperate to combat immigration other than Legitimacy. • I think that the issue of illegal immigration is closely related to the subject of development, as societies that suffer from the stumbling of development are mostly countries that export illegal immigration, while countries that are witnessing progress in development are countries receiving illegal immigration, and development here must It is on all economic, social and political levels, in addition to respecting human rights and fundamental freedoms.
